COHABITATION AGREEMENT

A couple who is living together, or intends to live together, may enter into a Cohabitation Agreement that covers their respective rights and obligations while they cohabit and in the event of their marriage or separation.

Upon marriage, this Agreement becomes their Marriage Contract, unless stipulated to the contrary in the Agreement.

Issues typically included in a Cohabitation Agreement include:

Ownership in or division of property;
Support obligations;
Children's education, (not the right to custody and access); and
Any other matter in settlement of their affairs.
